India's Tri-Service Act is a commendable step in this direction, where a focused strategy will be implemented to address specific risks, adopting a theater command approach. Theater command approach is already employed by many nations and has proven to be a time-tested mechanism.

Broadcasting Policy Must Exclude OTT: Stakeholders Urge Trai The media and entertainment industry in India is closely monitoring the formulation of the National Broadcasting Policy (NBP). Recently, stakeholders, including the Indian Broadcasting and Digital Foundation (IBDF) and the Internet and Mobile Association of India (IAMAI), have raised concerns about the scope of Trai's recommendations. Background: The Telecom Regulatory Authority of India (Trai) has been tasked with shaping the NBP, which will guide regulatory aspects and policy measures related to broadcasting, over-the-top (OTT) platforms, film, music, and online gaming. However, stakeholders are urging Trai to focus solely on broadcasting issues and exclude non-broadcasting areas. Why Exclude OTT? 1. Beyond Remit: Stakeholders argue that Trai has overstepped its jurisdiction by including topics like OTT, online gaming, film, and music. The MIB's reference letter primarily addressed broadcasting sector concerns. 2. Equal Opportunities: Trai's role should be to ensure equal opportunities for all players without discrimination. By narrowing the focus to broadcasting, the policy can address sector-specific challenges effectively. Timeline: Trai's consultation paper, titled "Inputs for the Formulation of National Broadcasting Policy-2024," sought feedback from stakeholders. Trai Chairman Anil Kumar Lahoti announced that NBP recommendations would be issued by the end of May. Key Issues in NBP (as per stakeholders): 1. Definition of Broadcasting in the OTT Age: Clarifying the boundaries between traditional broadcasting and OTT services. 2. Framework for Public Broadcasting: Establishing guidelines for public broadcasting. 3. Audience Measurement: Enhancing accuracy in measuring viewership. 4. Promotion of Local Content: Encouraging content creation within India. 5. Infrastructure Sharing: Addressing infrastructure challenges. While Trai's efforts are commendable, stakeholders emphasize that the NBP should stay true to its broadcasting focus. Can India’s legacy media based in Noida revive itself? Posing this question is akin to wondering whether the old model black-and-white EC television sets could make a resurgence in the era of smart TVs. The Erosion of Audience Base The redemption of Noida’s traditional media from the predicament it has fashioned for itself appears highly improbable. It requires no profound insight to discern that these expansive media conglomerates have steadily eroded their own audience base. Many households have ceased to subscribe to these channels via DTH services. Comparative Viewership A mere glance at their live viewership on YouTube starkly contrasts with that of independent journalists and commentators on alternative platforms. The disparity is vast. The legacy media no longer dictates the political agenda; that mantle has shifted to the other side. Superficial Introspection In the coming days, weeks, or months, one can expect superficial pronouncements from top executives and prime-time anchors, professing introspection and analysing past errors in strategy and judgement. However, I harbour serious doubts as to whether such exercises will suffice to restore the credibility these media entities have forfeited or reclaim the territory they have, either wittingly or unwittingly, ceded to genuine journalism flourishing elsewhere. Cosmetic Changes Replacing controversial on-air personalities might be another tactic to recapture some influence. Yet, as long as these entities remain reliant on the government for various concessions, including advertising, and their senior editors derive satisfaction from their associations with politicians, any tangible recovery seems unattainable. It is as unlikely as the comeback of the EC television set.

New Self-Declaration Certificate Required for All Ads in India The Ministry of Information and Broadcasting (MIB) has announced a new requirement for all new advertisements across TV, print, digital, and radio starting June 18, 2024. This requirement is a self-declaration certificate (SDC) that verifies the ad complies with regulations and doesn't mislead viewers. This mandate follows a Supreme Court order on May 7, 2024, requiring advertisers and agencies to submit an SDC before publishing or broadcasting any ad. Ads without a valid SDC will not be allowed to run. How it Works: - Advertisers will need to submit a certificate signed by an authorized representative through a new feature on the relevant portal: 1. Broadcast Seva portal for TV and radio ads ([Link Broadcast Seva Portal]) 2. Press Council of India (PCI) portal for print and digital ads ([Link Press Council of India]) - The portal will be activated on June 4, 2024. - Advertisers will need to provide proof of uploading the SDC to the broadcaster or publisher for their records. Concerns from Industry Bodies: - The Indian Society of Advertisers (ISA) and the Digital News Publishers Association (DNPA) have raised concerns about the practical difficulties of implementing this directive. Their concerns include: - The high volume of ads could make uploading SDCs a huge task. - The process could be time-consuming, costly, and labor-intensive for advertisers and agencies, potentially delaying ad launches. - For digital news publishers, programmatic advertising (which accounts for 42% of digital ad spending in India) poses a particular challenge. The ISA has suggested a one-time declaration from each advertiser or agency as a possible solution. Current Status: - The MIB has allocated a two-week buffer period (until June 18th) for stakeholders to familiarize themselves with the process. - This requirement applies only to new advertisements. Existing ads are not affected currently.
