In this article, Nivedita Nivargi (Partner) and Ayushi Harsh (Senior Associate) review the Draft Trade Marks (Holding Inquiry and Appeal) Rules, 2024 (“the Rules”) and delve upon the salient features. On July 01, 2024, the Department for Promotion of Industry and Internal Trade (under the Ministry of Commerce and Industry) introduced the draft of the Rules. The proposed amendments have been made by the Central Government under the powers vested in Section 157(1) of the Trade Marks Act, 1999 (“the Act”). The Rules were intended to be notified after the expiry of a period of 30 (thirty) days from the date on which the relevant notification was published and made available to the public i.e. from August 01, 2024. These Rules are a welcoming step towards streamlining and simplifying the process of trademark governance and boosting the efficiency of the adjudication process, by putting forth a designated procedure for adjudicating acts of violation of Section 107 of the Act. Provisions on electronic communications and time bound decisions reflect a progressive approach to boost the current Intellectual Property (“IP”) system in India. However, certain provisions are subject to clarification and it would be interesting to witness implementation of these Rules which are aimed to adjudicate the complaints and appeals both in an effective as well as an accelerated manner. https://lnkd.in/gJJJGDj4

Circuit House raised $4.3 million in the funding round, led by Stellaris Venture and 3one4 Capital. Circuit House is engaged in the business of contract manufacturing and sale of consumer electronics such as smart televisions.
