Tanner De Witt Employment Law Update - 9 July 2024 In the recent case of GUTING, JOAN SARMIENTO, DECEASED v CHOY CHIU YEE RITA [2024] HKDC 747, dealing with consolidated claims for discrimination, harassment and unlawful termination whilst on sick leave, the court ruling highlights the following: 1) It is lawful to terminate an employee even if they are ill, if there is no current sick leave certificate covering the actual date of termination, and; 2) it is not unlawful disability discrimination and disability harassment if the relevant acts (in this case, termination of employment) were motivated by reasons other than the disability. This case again highlights the importance of pre-existing evidence and of a “paper trail” showing the real reasons and motivations that predated the disability. Marking the end of Pride Month this year, Family Partner Joanne Brown and Associate Kathy Siu have written an article discussing marriage equality in Hong Kong, providing an overview of current progress, as well as outline of the necessary steps to provide equal legislative rights. The firm will make a donation to Hong Kong Marriage Equality, an NGO dedicated to advancing fair treatment for same-sex couples and eliminating discrimination against same-sex couples, and promoting diversity in society and the development of law relating to LGBT+ equality in Hong Kong. We hope that together our community can support and advance the issue such that marriage equality can finally be reached.
