Terms and Conditions for the use of TIM Analytics

Access to, and use of, any part of the TIM website (hereinafter "the Website"), any document, material or other information, including data (hereinafter "Information") made available on the Website, and any of the software services provided via the Website (hereinafter "Services") are governed by these general terms and conditions of use (hereinafter "General Terms") and constitute acceptance of these General Terms by the user.

 

BY USING THIS WEBSITE, YOU AGREE TO BE BOUND TO THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ANY OF THE TERMS OR CONDITIONS PROVIDED HEREIN, PLEASE DO NOT USE THIS WEBSITE OR ANY INFORMATION OR SERVICE HEREIN.

 

Specific terms and conditions may apply to individual services or specific parts of the Website as indicated for those concerned services or parts. Where provided, specific terms shall supersede any differing provision of the General Terms in respect to those services or parts.

 

1. Use of the website and user obligations
1.1. The Website offers access to Information and Services by means of informatics systems. While such systems are accessible by anybody, user authentication may be required. Users may access the Website and use its Services in order to access the Information for their own purposes.
1.2. Access to the Services does not grant users any proprietary right with respect to those Services or to any Information made available to them on the Website which shall remain exclusively vested in their respective owner(s).
1.3. Users of the Website shall comply with any all applicable laws and regulations. Users must refrain from attempting or performing any activity that could harm or violate the Website's network performance and/or security, or any other activity driven by unlawful purposes.
1.4. Users shall not use any software or other technical means to monitor or copy the Website (or any part thereof) or its content. In particular, any systematic extraction and/or scraping of the underlying data sets or portions thereof are prohibited.
1.5. Any violation of these General Terms may entail the loss of the right to further use this Website, and may be prosecuted and sanctioned.
1.6. Where Information, in the form of graphs, is incorporated in scientific or technical publications, users undertake to provide suitable acknowledgement to the TIM project using the following string: '[graph description] courtesy of the European Commission JRC, TIM project.'

 

2. Intellectual property rights
2.1. This Website as well as the assets used to offer Services are protected under intellectual property law including, but not limited to, copyright.
2.2. Any use of the Services shall not confer any intellectual property rights or other proprietary right to the user. No provision herein shall be deemed to affect the ownership and interest of the European Union and/or of any other concerned right-holder(s) in the Services, the Information and any intellectual property rights thereto which shall remain vested in their respective owners. For the sake of clarity, in view of third-party data being used for the provision of the Services, the Information is NOT subject to the application of the Commission Reuse Decision 2011/833/EU.
2.3. Any independent intellectual property right generated as a result of elaborating/or transforming the Information shall be owned by the user concerned.

 

3. Liability and warranty disclaimer
3.1. The European Commission aims at minimising technical errors and malfunctions. However, in some case, data or other parts of the Information may not be error-free. The European Commission does not accept any responsibility for the accuracy of the Information; in particular, no assurance is provided that the Information is complete or up-to-date.
3.2. Whilst the European Commission is committed to ensuring that the availability of the Website will be essentially uninterrupted and that transmissions will be error-free, this cannot be guaranteed. The Services are provided "as is" without warranty of any kind, either express or implied, including, but not limited to, any implied warranty against infringement of third parties' property rights, of merchantability, integration, satisfactory quality and fitness for a particular purpose.
3.3. Access to the Website and its Services may also occasionally be suspended, restricted or impeded in order to perform repairs, maintenance operations or to introduce new services. The European Commission will not be liable for any incidental, consequential, direct or indirect damages including but not limited to the loss of data, lost profits, or any other financial loss arising from the use of, or inability to use, the Services even if the European Commission has been notified of the possibility of such loss, damages, claims or costs or for any claim by any third party. The entire risk as to the use, quality, and performance of the Services is with the user.
3.4. The User may not use the Information or the Services in a manner which may mislead or confuse people into believing that any products and services provided by the User are in some way endorsed or certified by the European Union. Under no circumstance shall the User use the European Commission logo or otherwise spend the official name and credentials of the European Commission to imply affiliation, endorsement or other official link to European Commission unless explicitly permitted under the European Commission's visual identity policy (https://ec.europa.eu/info/resources-partners/european-commission-visual-identity_en)

 

4. Privacy and data protection
4.1. When the Website is accessed, certain information about users, such as internet protocol (IP) addresses, navigation through the site, software used and time spent, may be stored. This information may be used for website traffic analysis only, and not to identify users. No attempt will be made to monitor systematically individual users of IP addresses, or the actions that they perform.
4.2. The general principles of Data Protection shall be applicable.
