U.S. regulators are investigating potential unfair trade practices within pending Canadian regulations governing ballast water management systems of ships in the U.S.-Canada Great Lakes trade. The Federal Maritime Commission (FMC) launched this probe to determine if the pending regulations disproportionately affect U.S.-flagged vessels, potentially violating U.S. shipping practices laws. U.S.-based shipping companies claim the new Canadian regulations, effective September 2024, would impose severe burdens on their operations, giving Canadian competitors an unfair advantage. The regulations require American vessels loading ballast water in Canadian Great Lakes waters to use treatment equipment, even when discharging in U.S. waters, overriding U.S. EPA and Coast Guard regulations. Notably, the Canadian government has provided relief processes for Canadian vessels but not for U.S.-flag vessels, which could halt U.S. exports to Canadian Great Lakes ports. The FMC's investigation will determine the fairness of these regulations, with a report expected within 120 days. Container cargo bulls, bears sighted along North America’s West Coast Sightings of #transpacific cargo market bulls and bears are on the rise as May gives way to June and the peak summer container shipping season approaches. For Canada’s West Coast ports, bear-watch worries are magnified by threats of port and railway labour disruptions. But, first up, a running of the bulls. April numbers from New York-based container shipping analyst John #McCown show year-over-year increases in April’s inbound (up 12.6%) and outbound (up 7.6%) containers from the top 10 U.S. ports. For inbound containers, McCown notes that April marks the third straight month of double-digit increases and caps the highest three-month run since the pandemic. 2024’s bullish beginning is echoed by major ocean carrier lines. According to A.P. Moller-Maersk’s (CPH:MAERSK-B) Q1 2024 financial report, the world’s second largest container shipping company has raised the lower end of its 2024 EBITDA guidance to US$4 billion–US$6 billion from its previous US$1 billion-US$6 billion. Optimistic considering that a new-ship order book totalling almost 30% of capacity that is set to join the global fleet this year and next will largely offset container demand that grew an estimated 7% to 9% in Q1 2024 compared with Q1 2023 and will depress container shipping rates that were down 18% compared with Q1 2023.  Maersk pointed to the U.S. consumer as a “bright spot in the global economy.” Still, that bright spot is largely riding atop a huge bubble of debt. And while McCown’s April numbers show upbeat transpacific cargo flow, it continues to migrate away from West Coast ports to their Gulf and East Coast counterparts. Drought-driven restrictions that have reduced the number of ship transits through the Panama Canal since July 2023 are also beginning to ease. That will make West Coast alternatives more attractive. But for Canada’s West Coast ports the more immediate concern is the stalled contract negotiations between the BC Maritime Employers Association and Longshore and Warehouse Union Ship & Dock Foremen #Local 514 and the looming shutdown of passenger and freight rail service in Canada following the failure of #Teamsters Canada Rail Conference and #Canadian National Railway Co. (TSX:CNR) and #Canadian Pacific Kansas City Ltd. (TSX:CP) to reach a contract agreement. As a result, the memo from Canada’s transportation unions and their employers to the wider world is this: shippers can’t rely on the integrity of Canada’s supply chain. Without that integrity, global shipping lines will resort to short-term options that could become permanent.
