- In all orders, the shipping fee will be paid by the BUYER as the product shipping cost. It is the buyer’s responsibility to ensure that the cargo is safe.
- In the event that it becomes impossible to sell the product purchased, then the seller is required to notify, in writing, the purchaser of such situation within a period of 3 days after the seller knows about the situation. The total price is required to be returned to the Purchaser within a period of 14 days.
IN CASE OF FAILURE TO PAY THE PRICE OF THE PRODUCT PURCHASED:
5. In the event that the purchaser fails to pay the price of the product purchased, or that s/he/it cancels such payment in the bank records, then the Seller, obligation to deliver the product shall be terminated.
IN CASE OF FAILURE TO DELIVER THE PRODUCT TIMELY DUE TO THE UNEXPECTED REASONS:
6. In case of occurrence of any force majeure that cannot be foreseen by the Seller, and in case of any failure to deliver the product timely, then the Purchaser shall be notified of such matter. The purchaser may request cancellation of the order, or replacement of the product with a similar one, or postponement of the delivery until the problem is solved. In the event that the purchaser cancels the order, the price of the order shall be paid to her/him/it in cash within a period of 14 days as of the date of cancellation of the order in case of performance of the payment in cash. In the event that the purchaser has performed the payment through the credit card, and that s/he/it cancels the order, then the price of the product shall be refunded to the bank within a period of 14 days as of the date of such cancellation; however, it shall be possible for the bank to transfer such refund to the purchaser’s account within a period of 2 3 weeks.
OBLIGATION OF THE PURCHASER TO CHECK THE PRODUCT:
7. The purchaser shall examine the goods/service, constituting the subject matter of the agreement, before receipt thereof; and any damaged and defective goods/service, which is crushed, broken, torn-package, etc., shall not be received from the shipment company by the purchaser. The goods/services received shall be deemed undamaged and intact. The PURCHASER is required to protect the goods/services carefully upon delivery thereof. In case of possibility to exercise the right of withdrawal, then the goods/services must not be used. The invoice must also be returned along with the product.
RIGHT OF WITHDRAWAL:
8. The PURCHASER may exercise its right to withdraw from the agreement by rejecting the goods without assuming any legal and criminal liability and without any justification within a period of 14 (fourteen) days as of the date of delivery of the product to the Purchaser or to the person/organization situated at the address specified by the Purchaser, provided that the SELLER shall be notified of the matter through the following contact details.

9. In the event that the purchaser purchases any service, then such period of 14 days shall start as of the date of execution of the agreement. In respect of the service agreements, under which the performance of the service is started upon the approval of the consumer, the right of withdrawal may not be exercised prior to expiration of the withdrawal period.
10. The costs arising from the exercise of the right of withdrawal shall be borne by the SELLER.
11. In order to exercise the right of withdrawal; the BUYER is required to notified, in writing, of the relevant matter by return receipt requested mail, e-mail or fax within a period of 14 (fourteen) days, and the product is required to be unused in accordance with the provisions for “Products Not Covered By Right of Withdrawal” as prescribed hereunder.
EXERCISE OF RIGHT OF WITHDRAWAL:
12. The invoice of the product delivered to any 3 rd party or the PURCHASER (in the event that the invoice of the product to be returned is issued as a corporate invoice, then it is required to be submitted along with the return invoice, which is issued by the institution, in case of return of the product. The order returns, the invoices of which are issued in the name of the institutions, shall not be completed unless the RETURN INVOICE is issued.), and
13. The return form is required to be delivered in a complete and undamaged manner along with the box, packaging and standard accessories, if available, of the products to be returned. In the event that the product returned is damaged although such damage is caused by the shipping company, then the return process shall be completed upon deduction of the damage cost from the amount of return. In the case of performance of any return process without approval of BAŞAK BAYSAL, then the return process shall not be accepted, and the consignment shall not be received.
TERMS AND CONDITIONS FOR RETURN:
14. The SELLER shall be obliged to refund the total price and to return the documents, which bind the PURCHASER, to the PURCHASER within a period of 10 (ten) days as of the date of receipt of the withdrawal notification by the Seller, at the latest, and also to accept the return of the goods within a period of 20 days.
PRODUCTS NOT COVERED BY RIGHT OF WITHDRAWAL:
- The products, which are prepared upon the PURCHASER’s request or based on her/his/its clearly personal needs, and which are not available for return, and which are not appropriate to be returned in terms of health and hygiene in the event that their package is opened by the PURCHASER upon delivery thereof to the PURCHASER, and also which are mixed with the other products upon their delivery, and accordingly which cannot be separated by their nature, shall not be returned in accordance with the Regulation in the event that their package is opened by the PURCHASER. The purchaser may not exercise her/his/its right of withdrawal with respect to the products, which are produced upon the special request and demand of the purchaser, and which are customized by performing changes therein or additions thereto. Also, it shall not be possible to exercise the right of withdrawal with respect to the services, which are started to be performed upon the approval of the consumer, prior to expiration of the withdrawal period in accordance with the Regulation.
EVENT OF DEFAULT AND LEGAL CONSEQUENCES THEREOF
- The PURCHASER hereby acknowledges, represents and warrants that the card holder shall pay an interest in accordance with the credit card agreement, which is executed by and between the card holder and the bank, and s/he/it shall be accountable to the bank for such matter in the event that s/he/it goes into default in case of performance of her/his/its payments through the credit card. In such case, the relevant bank may take legal actions, and it may object any claim against the PURCHASER with respect to the costs and the attorney’s; in any case, in the event that the PURCHASER goes into default due to her/his/its debt, then the PURCHASER hereby accepts that the s/he/it shall pay the damages and losses incurred by the SELLER due to the delayed performance of the debt.
