The Fair Work Commission Annual Wage Review decision is an exciting day for industrial relations nerds like myself 🤓 To help you unpack the decision and understand what it means for you or your business in a practical sense, we have put together an article that summarises the decision here: https://lnkd.in/gJzHSVvb Interestingly, as more data becomes available we are starting to get a better picture of the distribution of employment arrangements and how they apply to Australian workers 📊 see 🥧 chart below ⬇️ Key Insights ☑️ The Fair Work Commission has handed down the 2024 Annual Wage Review decision, resulting in a 3.75% increase for employees engaged under modern awards. This will see the national minimum wage increase to $915.90 per week or $24.10 per hour effective from 1 July 2024. ☑️ It is estimated that 25% of Australian workers are covered by a modern award, 34% under an enterprise agreement and the remaining 41% under contract or other employment arrangements. ☑️ Wages in Australia are increasing, with employees engaged under an enterprise agreement receiving an average annual wage increase of 4.3% and the Wage Price Index (WPI) at the March 2024 quarter sitting at 4.1% (Australian Bureau of Statistics 📈). #WorkplaceRelations #IndustrialRelations #AustralianEmploymentLaw #FairWork #HumanResources

Skills & jobs: Investment to bolster training in the construction, manufacturing and clean energy industries with additional support to attract more women into these male dominated sectors. Govt Parental leave: Superannuation to be paid on top of government paid parental leave from 1 July 2025 with a view to reducing the 25% gap that exists on retirement between men’s and womens’ super balances. Mental health: Significant investment over 8 years to enable people to get the mental health support with further money allocated to supporting the mental health of small business owners with access to confidential support. Domestic Violence prevention: A $925 million package to help secure safety, economic security and independence of victim-survivors of family and domestic violence. Plumbers and electricians must respond to urgent domestic situations, mechanics are called out to get broken down vehicles and people out of danger, energy workers attend to power failures which can result in fatalities, medical staff save lives by remaining on call, police are relied upon to respond to urgent matters, almost every sector has some kind of risk that requires certain people to answer the call when needed. For these circumstances, Modern Awards or other industrial instruments already provide for payment terms and conditions – and no business can lawfully remunerate their people less than these minimum standards of pay. So, what then, is the Fair Work Commission going to possibly draft that won’t further encroach on workplace level job design when the Modern Award system already accounts for (anecdotally) 90% of the scenarios where after hours work or contact is required? #RighttoDisconnect

Key legislation changes in HR (2024/25) We’re all aware that 2024 has brought a burst of legislative changes that are reshaping features of Australia’s workplaces and practices that have been followed. Heading into the latter half of the year, here’s a quick refresher. That is, a rundown of key legislative updates that affect our workplaces: 1. Wage theft is getting serious. By 2025, employers could face up to $7.8M in fines and 10 years jail time for deliberate underpayments. Time to double-check those payroll systems. 2. Casual work is being redefined. The ‘Closing Loopholes Bill’ is shaking things up, taking a closer look at the ‘real substance’ of employment relationships. This could change how we engage with casual workers. 3. Domestic violence protections are expanding. New laws make it illegal to discriminate against employees experiencing family/domestic violence. It’s a step forward in reducing stigma and supporting affected workers. 4. Gender pay gap transparency is coming. Large employers, get ready – your gender pay gaps may be public soon. The Workplace Gender Equality Agency (WGEA) was expected to publish private sector employer’s data from late February, and public sector data from later this year or early 2025. These changes are significant, and only a few of them, and will require some adjustments from HR teams and business leaders. Is your business ready for these legislative changes?
