PORTLAND, Ore. (KATU) - A Black man from Portland is suing Red Robin for $1 million, claiming he was the victim of discrimination and sexual abuse.

Attorneys representing the man tell KATU he found semen in his salad after a confrontation with an employee. The lawsuit states it happened about a year ago at a Red Robin in Clackamas.

They claim the man and his family went out to eat, and management told him they couldn't seat them together because his party of six was too large. They say his family was also referred to as "a gang," something he found offensive given he's a Black man and his family is of mixed race.

They eventually sat down to eat. According to attorneys, it wasn't until the man was halfway finished with his food that he says he found semen in his salad.

Attorney Jason Kafoury of Kafoury & McDougal said they are hoping DNA evidence will show who's responsible.

"There's no debate that the substance was semen, and it wasn't his. Now it's a question of whose semen was it,” said Kafoury. “The truth is, this is a case where DNA is going to provide us an answer right? It's somebody's semen."

Attorneys say they're waiting for DNA results from law enforcement.

The Clackamas County Sheriff's Office is investigating.

KATU reached out to Red Robin for a comment and have not heard back.
